The fact that a father wants primary custody or a 50/50 possession schedule, but they wouldn’t voluntarily pay to support the child is one of our favorite areas of cross examination to use against a father when we are representing the other parent. This is one of the most effective arguments that we can make against a father. Even better would be the scenario in which the child is a newborn and the father refuses to even buy diapers or formula for the infant. If you are a father and you want a chance in court, there is simply no justification for failing to pay at least some amount toward child support or for failing to contribute toward the cost of groceries and other necessities. The judges despise this, particularly those judges who either have children of their own or who formerly worked as attorneys in the field of family law. If a father wishes to have any credibility in court, he should pay at least some child support even if the court does not order him to do so. The amount of child support paid does not have to be in perfect accordance with the child support standards, but he should pay something.
