Child Support LAWYERS IN CHILD SUPPORT CASES LOCATED IN KATY, TEXAS

Experienced Child Support Representation Fort Bend, Harris, and Surrounding Counties

In principle, determining child support should be a straightforward matter under Texas Family Law that may be easily settled by the courts and the parents. However, the process of establishing, modifying, and enforcing child support is impacted by a variety of factors, which creative child support lawyers can argue in a variety of different ways in order to achieve the interests of their clients. This is similar to how a full-blown child custody lawsuit is impacted by these factors. When compared to the Texas Child Support Guidelines, the failure to have an experienced Child Support Lawyer on your side can, unfortunately, mean the difference between receiving or paying a child support amount that is unreasonable and overly burdensome. This can happen either to the paying parent or the receiving parent.

Nick Davis Law provides a free Child Support Case Evaluation to any and all potential clients over the phone or through a virtual conference, in addition to flexible payment options.

IS YOUR CHILD SUPPORT CASE CONTESTED?

The guidelines are not ironclad in any way. As part of an Uncontested Divorce or Uncontested Child Custody Agreement, it is possible for parents to voluntarily agree to pay higher child support. This may be done in any scenario. The majority of the time, judges in family court will not dispute the child support payments that the parents have agreed to make for their kid as long as the payments are either based on the guidelines or at the very least look to be significant enough to provide for the child. Child support payments that, even if agreed to by the parties, appear to be too low or are based on calculations using the minimum wage may draw questioning from the court to assess if they are suitable. This is true even if the parties have reached an agreement on the amount.

In the event that the parties are unable to reach an agreement for child support and the guidelines would not be suitable because the payment would be either too low or too high, one of the parties may choose to contest the amount. In order to do this, you need to hire an experienced child support lawyer who can evaluate a range of issues that have the potential to influence the decision that the court makes about child support.

Nick Davis Law’s Child Support Attorneys are able to assist you in safeguarding your rights to receive child support payments.

The amount of child support owed in the state of Texas is calculated by deducting a predetermined sum as a percentage of the non-custodial parent’s total net income. This takes into account money received from any and all sources. The percentages are broken down as follows according to the number of children that are owned by the parent who does not have primary custody of those children:

One Child – 20% of net monthly income

Two Children – 25%

Three Children – 30%

Four Children – 35%

Five or More Children – 40%
